The General Terms and Conditions of Sale (“General Conditions of Sale”, or “GTC”) apply exclusively to the online sale of products offered by the Operator on the Website.
The GTC are made available to customers on the Website where they can be consulted directly, and can also be communicated upon simple request by any means.
The GTC are binding on the customer, who acknowledges having read and accepted them before placing an order by checking a box or clicking on the button provided for this purpose. The validation of the order by confirmation constitutes acceptance by the buyer of the GTC in force on the date of the order, the retention and reproduction of which are ensured by the Operator.
Article 3 – PRODUCT DESCRIPTION
The Site is an e-commerce website selling honey and hive products (hereinafter the “Product(s)”) accessible to any natural or legal person using the Site (the “Customer”).
The Products presented on the Site are each accompanied by a description (provided by the supplier or accessible on the manufacturer’s site via a link on the Site) specifying their essential characteristics. Photographs illustrating products, where applicable, do not constitute a contractual document. Products comply with the requirements of current French law.
The Customer remains responsible for the conditions and consequences of their access to the Site, particularly via the Internet. This access may involve payment of fees to technical providers, such as Internet access providers, which remain at their expense. Furthermore, the Customer must provide and be fully responsible for the equipment necessary to connect to the Site.
The Customer acknowledges having verified that their IT configuration is secure and in working order.
Article 4 – CREATION OF THE CUSTOMER AREA
To place an order on the Site, the Customer must first create a personal customer area. Once created, to access it, the Customer must log in using their username and secret, personal, and confidential password. The Customer is responsible for not sharing their username and password in accordance with the PERSONAL DATA provisions of these General Conditions. Each Customer agrees to maintain strict confidentiality over the data allowing access to their customer area, recognizing that they are solely responsible for access to the Service via their username and password, except in cases of proven fraud. Each Customer further agrees to immediately inform the Operator in the event of loss, misappropriation, or fraudulent use of their username and/or password.
After creating their personal customer area, the Customer will receive an email confirming its creation.
The Customer agrees upon registration to:
• provide true, accurate, and up-to-date information at the time of entry into the service registration form, and in particular not to use false names or addresses, or names or addresses without authorization.
• keep registration data updated to ensure its accuracy at all times.
The Customer further agrees not to make available or distribute unlawful, objectionable (such as defamatory or identity-theft information), or harmful content (such as viruses). Otherwise, the Operator may suspend or terminate the Customer’s access to the Site at their sole fault.
Article 5 – ORDERS
The Operator strives to ensure optimal availability of its Products. Product offers are valid within the limit of available stocks.
If, despite the Operator’s best efforts, a Product becomes unavailable after the Customer’s order, the Operator will inform the Customer by email as soon as possible, and the Customer will have the choice between:
• delivery of a Product of equivalent quality and price to that originally ordered, or
• a refund of the price of the ordered Product within thirty (30) days of payment of the sums already paid.
Except for the refund of the price of the unavailable Product if requested by the Customer, the Operator is not liable for any cancellation indemnity, unless the non-performance of the contract is personally attributable to them.
Unless otherwise stated in these General Conditions and without prejudice to the right of withdrawal provided by applicable law, Customer orders are firm and final.
When placing an order, the Customer must select the chosen Products, add them to their cart indicating the selected items and desired quantities. The Customer can check the details of their order, the total price, and return to previous pages to correct cart contents before validating.
The Customer undertakes to read the GTC in force before accepting them and confirming delivery terms and potential fees prior to payment. Order confirmation implies acceptance of the GTC and forms the contract.
The GTC are available at any time in the Website footer under “GTC”.
Contractual order information (including order number) will be confirmed via email in due course and at the latest upon delivery. The Operator strongly advises the Customer to print and/or archive this order confirmation. A digital invoice is available in “My Account” and sent by email once payment is received.
Any email sent to the Customer regarding an order will be sent to the email address used to log into their customer area.
The Operator reserves the right not to validate an order for any legitimate reason, particularly if:
• The Customer does not comply with the GTC in force at the time of order;
• The Customer’s order history shows unpaid amounts from previous orders;
• A previous order is subject to an ongoing dispute;
• The Customer failed to respond to an order confirmation request sent by the Operator.
